1) Acceptance of terms
These Terms & Conditions (“Terms”) govern your access to and use of the MzansiFood website and mobile apps (the “Services”). By creating an account, placing an order, or using the Services, you agree to these Terms and any policies referenced here (including our Privacy Policy and Return & Refund Policy).
If you do not agree, please do not use the Services. Where permitted by law, we may update these Terms from time to time (see Changes).
2) About MzansiFood (marketplace)
MzansiFood is operated by MzansiForSho (Pty) Ltd. We provide a digital marketplace that connects customers with independent restaurants, retailers and delivery partners. Unless stated otherwise, MzansiFood is not the seller of the goods; the relevant vendor is responsible for product quality, preparation, labelling, allergen disclosures and compliance with applicable laws. Delivery may be handled by the vendor’s own drivers or by independent couriers using our platform.
3) Eligibility & accounts
- You must be at least 18 years old to create an account and place orders.
- You are responsible for maintaining the confidentiality of your login details and for all activity on your account.
- Provide accurate, complete information and keep it updated (e.g., delivery address, phone number).
- We may suspend or terminate accounts for suspected fraud, abuse or breach of these Terms.
4) Orders, availability & substitutions
- Items shown are subject to availability. Vendors may reject, cancel, or amend an order (e.g., out of stock).
- Substitutions: If the vendor permits, they may offer a reasonable substitute; you’ll see this in the app or be contacted for approval.
- Allergen & dietary info is provided by the vendor. Always check labels and consult the vendor for allergy concerns.
5) Pricing, fees & taxes
- Prices are set by vendors and may differ from in-store prices.
- Service fees, delivery fees, small-order fees and surcharges may apply and will be shown at checkout.
- Prices typically include VAT where applicable; line items at checkout reflect taxes/fees before you pay.
- We may run dynamic pricing or promotions that change from time to time.
6) Payments
We use PCI-DSS–compliant payment processors. By submitting a payment, you authorise the charge for your order and applicable fees. We generally do not store full card details; our processors may store tokens for your convenience. If a payment fails, we may reattempt or request another payment method.
7) Delivery, ETAs & pickups
- Delivery windows and ETAs are estimates only. Actual times depend on vendor prep, traffic and courier availability.
- Please ensure your address and contact details are correct and that you are available to receive the order.
- For pickups, collect within the vendor’s stated window to maintain quality and safety of the items.
- Risk in goods passes to you on delivery (or when collected by you). Title passes when you have paid in full.
8) Cancellations & refunds
Perishable items (e.g., prepared food) are generally not eligible for “change-of-mind” returns under the South African Consumer Protection Act (CPA). However, if there is a problem with your order (missing items, incorrect items, quality concerns), please report it promptly via the app or contact us. Our process is detailed in the Return & Refund Policy.
Orders may be cancelled before a vendor begins preparing the items; once preparation starts, cancellations may not be possible. Refunds (where approved) are returned to your original payment method within a reasonable time, subject to your bank’s timelines.
9) Promotions, vouchers & loyalty
- Promo codes, credits and loyalty rewards are subject to their specific terms (expiry dates, minimum order values, geographic limits).
- Promotions cannot be exchanged for cash and may be withdrawn or modified where permitted by law.
- Abuse or misuse (e.g., multiple accounts, fraudulent referrals) may result in loss of benefits and account action.
10) Ratings & reviews
You may rate and review vendors and couriers fairly and lawfully. Do not post unlawful, defamatory, hateful, harassing, obscene or infringing content. We may remove content that violates these rules or applicable law.
11) Acceptable use
- Do not interfere with the Services, attempt unauthorised access, or use the Services for unlawful purposes.
- No scraping, reverse engineering (except to the extent allowed by law), or automated bulk requests without our consent.
- Do not impersonate others or misrepresent your affiliation.
12) Intellectual property
The Services, including logos, brand elements, software, text and media, are protected by intellectual property laws. You may not use our marks without prior written permission. Vendors retain rights in their respective menus, logos and content.
13) Third-party services
We use third-party tools such as Google Maps Platform (e.g., Places Autocomplete, Distance Matrix) to improve address search and routing. Your use of those features may be subject to the third party’s terms and privacy notices.
14) Privacy & cookies
Our handling of personal information is described in the Privacy Policy. We use cookies/SDKs to operate and improve the Services and, where required, we present a cookie banner to manage your preferences.
15) Warranties & disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation. Vendors are responsible for their products and compliance; couriers are responsible for delivery services they provide.
16) Limitation of liability
To the extent permitted by law, MzansiForSho (Pty) Ltd will not be liable for indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, goodwill or data, arising out of or related to your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., liability for death or personal injury caused by negligence).
17) Indemnity
You agree to indemnify and hold harmless MzansiForSho (Pty) Ltd, its directors, employees and agents from claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, unlawful use of the Services, or violation of third-party rights.
18) Governing law & disputes
These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act (CPA), the Protection of Personal Information Act (POPIA) and the Electronic Communications and Transactions Act (ECTA). Courts of South Africa will have jurisdiction, subject to any mandatory consumer rights to approach the relevant forum. We encourage you to contact us first to resolve any concern.
19) Changes to these terms
We may update these Terms to reflect changes in our Services or the law. When we make material changes, we will take reasonable steps to notify you (e.g., in-app notice or email). Your continued use of the Services constitutes acceptance of the updated Terms.
